These Terms and Conditions (“Terms”) govern the use of services provided by BOB COX HOLDINGS PTY LTD, trading as Poseidon Pools CQ (ABN 93 636 725 810), and your interactions with our team, website, and communications.

By engaging with our business (via quote request, consultation, or contract), you agree to be bound by these Terms.

1. Scope of Services

Poseidon Pools CQ provides services including, but not limited to:

New swimming pool construction (fibreglass, concrete, plunge)
Pool cleaning and maintenance
Filter system replacement
Commercial pool servicing

Each service is subject to a separate written quote and may require a formal contract agreement.

2. Quotes & Estimates

All quotes are free and valid for 30 days from the date of issue.
Quotes include an itemised breakdown of inclusions, options, and final costs.
Verbal estimates or ballpark figures are indicative only and non-binding.

3. 7-Day Quote Guarantee

We proudly offer a 7-Day Quote Guarantee on new pool construction consultations.

Guarantee Terms:

If we fail to deliver your written quote within 7 days of our onsite consultation, you’ll receive a $150 credit applied to your final pool build invoice.

Force majeure (e.g. severe weather, public holidays, emergencies)
Jobs requiring external engineering or custom approvals

4. Deposits & PaymentsWe proudly offer a 7-Day Quote Guarantee on new pool construction consultations.

A 10% deposit is typically required to secure your booking and materials.
Additional progress payments may be required depending on the project scope.
Final balance is due upon practical completion or handover.
Late payments may incur a fee or result in suspended services.

5. Cancellations & Refunds

Cancellations made prior to work commencement may be eligible for a partial refund, less any expenses incurred.
Custom orders or third-party service fees may be non-refundable.
Once installation or service has begun, refunds are at our discretion and may be subject to deductions.

6. Warranties & Liability

New pool installations come with manufacturer warranties and our workmanship guarantee.
Pool equipment is covered under the respective brand warranty (e.g. filtration, heating).
Poseidon Pools CQ is not liable for delays caused by supply chain issues, acts of nature, or third-party contractors.

7. Council & Compliance

We will assist with council applications and ensure the project complies with Queensland Building & Pool Safety Standards.
The client is responsible for disclosing easements, covenants, or underground services.

8. Intellectual Property

All content, designs, plans, and materials we supply remain the property of Poseidon Pools CQ unless otherwise agreed in writing.

9. Privacy

All personal data is handled in accordance with our Privacy Policy, in line with the Australian Privacy Act 1988.

10. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes shall be resolved in Queensland jurisdiction.
